Health & Safety Code 1597.531 Mandatory Liability Insurance or Bond for Family Day Care Homes, Homeowner Association as Additional Insured.
(B) A family day care home that maintains liability insurance of a bond pursuant to this section, and that provides care in premises that are rented or leased or uses premises which share common space governed by a homeowner's association, shall name the owner of the property of the homeowners association, as appropriate, as an additional insured party on the liability insurance policy or bond if all of the following conditions are met. (1) The owner of the property or governing body of the homeowners association makes a written request to be added as an additional insured party. (2) The addition of the owner of the property or the homeowners association does not result in cancellation or non-renewal of the insurance policy or bond. (3) Any additional premium assessed for this coverage is paid by the owner of the property of the homeowners association.
IX - PETS AND OTHER ANIMALS - (taken from CLRCA' Governing Documents -CC&R's)
No horses, cattle, sheep, goats, poultry, rabbits, or pigs, or any other livestock or animals of any description may be kept or permitted on any lot or lots with the exception of dogs, cats, and other household pets. All dogs shall be confined or on owners' controlled leashes at all times and shall be subject to the provisions of CC&R's Art. XII regarding unwholesome conditions, annoyance, nuisance, noise, odor and disturbing the peace, quiet, comfort or serenity of occupants of nearby lots. The breeding, training of, or dealing in dogs, cats or other animals shall not be permitted.
ARTICLE VI - DIRECTORS- (Taken from CLRCA Governing Documents- By-Laws)
Section 2 (a) The Board of Directors shall have the general management and control of the business and affairs of the Association and shall exercise any and all of the powers that may be exercised or performed by the Association under the law, the Articles of Incorporation and these By-laws and shall establish policies based on the budget.
(b) The Board of Directors shall make and enforce such rules and regulations as they deem necessary, to accomplish or promote the objects and purposes of the Association and the best use of its property, assets and facilities.
(c) The Board shall use its best efforts consistent with the prudent conduct of the Association's activities, to manage the Association's financial affairs within its budget. The Board shall report to the members by such means reasonably available to it, when the Board believes an action taken will reduce total income or increase total expenses by ten percent (10%) or more of the amounts projected in the budget.
